1. Acceptance
By registering for or using the Qusto platform ("Service"), you agree to these Terms of Service ("Terms"). If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Description of Service
Qusto provides a privacy-first e-commerce analytics platform including revenue tracking, multi-touch attribution, funnel analysis, and product analytics. The Service is currently offered in an invite-only beta phase.
3. Beta Programme
Access to Qusto during the beta phase is granted by invitation only, via a single-use invite token. Beta access includes:
- Full access to Qusto Pro features throughout the beta period, at no charge.
- Direct communication channel with the Qusto team for bug reports and feedback.
- Participation in product roadmap discussions.
Beta disclaimer: The Service is provided "as-is" during the beta phase. Features, pricing, data retention limits, and service levels are subject to change before general availability. We will provide reasonable notice of material changes by email.
4. Account Registration
You must provide a valid business email address and maintain the security of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately at hello@qusto.io of any unauthorised use of your account.
5. Acceptable Use
You agree not to use the Service to:
- Transmit, store, or process personal data beyond what is necessary for e-commerce analytics.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use the Service to track individuals across websites without a lawful basis under applicable law.
- Introduce malicious code, conduct load testing without prior written consent, or interfere with Service availability.
- Resell, sublicense, or make the Service available to third parties without prior written agreement.
6. Data and Privacy
You retain ownership of all analytics data collected from your store. Qusto processes this data solely to provide the Service to you. Our processing of personal data is governed by our Privacy Policy and, where applicable, a Data Processing Agreement available on request at compliance@qusto.io.
7. Intellectual Property
The Qusto platform, trademarks, and proprietary software remain the intellectual property of Qusto. The open-source analytics engine (Qusto CE) is licensed under AGPL-3.0 — see github.com/qusto-io/qusto-ce.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Qusto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, arising from your use of the Service. Our total aggregate liability shall not exceed the amount paid by you to Qusto in the 12 months preceding the claim (or, during the free beta period, €100).
9. Termination
You may close your account at any time by contacting hello@qusto.io. Your data will be retained for 30 days following closure to allow export, then permanently deleted. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the European Union and applicable member state law. Any disputes shall be subject to the exclusive jurisdiction of the courts of the EU member state in which Qusto is established.
